These Terms of Service (“Terms”) govern the use of this website and all photography services provided. By booking services, accessing client galleries, or using delivered images, you agree to these Terms.

1. Services Provided

We provide professional photography services, including but not limited to:

• Real estate photography

• Short-term rental (Airbnb / VRBO) photography

• Commercial and architectural photography

• Digital image delivery via Pixieset

Specific deliverables, pricing, and scope of work are agreed upon prior to each project.

We do not guarantee specific business outcomes, including property sales, bookings, views, or revenue.

2. Booking & Scheduling

• Shoots are scheduled by mutual agreement

• The client is responsible for ensuring property access at the scheduled time

• The property must be ready for photography at the scheduled start time

Delays caused by lack of access, unprepared spaces, or client-side issues may result in reduced coverage or rescheduling at the photographer’s discretion.

3. Payment Terms

• Payment is due upon receipt of invoice unless otherwise agreed in writing

• Accepted payment methods include:

• PayPal (including Apple Pay)

• Zelle

• Cash (in person)

Image usage rights are granted only upon full payment.

In cases of non-payment, the photographer reserves the right to suspend gallery access and revoke usage rights.

4. Cancellations & Rescheduling

• A minimum of 24 hours’ notice is requested for rescheduling

• Same-day cancellations may be subject to a cancellation fee

• Weather-related rescheduling for exterior photography is handled at the photographer’s discretion

5. Image Delivery & Turnaround

• Images are delivered digitally via Pixieset

• Typical turnaround time is 24–72 hours, unless otherwise agreed

• Delivery timelines may vary due to workload, complexity, or unforeseen circumstances

Rush delivery is not guaranteed unless confirmed in advance.

6. Image Usage & Licensing

All images remain the exclusive property of the photographer and are protected by U.S. copyright law.

Upon full payment, the client is granted a non-exclusive, non-transferable license to use the images as outlined below.

Airbnb / Short-Term Rental Clients

Images may be used solely to market the photographed property as a short-term rental on platforms such as Airbnb, VRBO, direct booking sites, and related social media.

The license applies only while the client owns or manages the property and does not transfer to new owners, managers, or co-hosts.

Realtors / MLS Clients

Images may be used solely for marketing the specific property listing for which they were created, including MLS, real estate platforms, brokerage websites, and related social media.

Reuse for future listings, new owners, or different agents is not permitted without written consent.

Commercial / Other Clients

Images may be used only for the agreed-upon commercial purpose and scope defined at the time of booking. Additional usage requires written permission.

Images may not be sold, transferred, sublicensed, or reused beyond the licensed purpose without prior written consent.

7. Client Galleries & Storage

• Client galleries are hosted via Pixieset and may be password-protected

• Galleries are provided as a convenience for viewing and downloading images

• Long-term gallery storage is not guaranteed

• Gallery access may be suspended or removed in cases of non-payment or account issues

Clients are responsible for downloading and backing up delivered images.

8. Client Responsibilities

Clients are responsible for:

• Property cleanliness and readiness

• Staging and removal of unwanted items

• Securing pets and occupants during the shoot

The photographer is not responsible for moving heavy furniture or deep cleaning.

9. Limitation of Liability

The photographer is not liable for:

• Missed shots due to access issues or property conditions

• Circumstances beyond reasonable control (weather, illness, equipment failure)

• Business losses, lost revenue, or missed opportunities

Liability, if any, is limited to the amount paid for the services provided.

10. Indemnification

The client agrees to indemnify and hold harmless the photographer from claims arising from misuse of images, violation of third-party rights, or unauthorized distribution.

11. Force Majeure

The photographer shall not be held liable for failure to perform services due to events beyond reasonable control, including but not limited to severe weather, illness, emergencies, or equipment failure.

12. Governing Law

These Terms are governed by the laws of the State of Georgia, without regard to conflict of law principles.

13. Modifications to Terms

These Terms may be updated at any time. Continued use of services or access to galleries constitutes acceptance of the current Terms.
